Terms and Conditions

Membership

Members are required to be unattached, no longer living under the same roof as/with an ex-partner and required to maintain contact with The County Register regularly (updating their details as required) and give true and accurate information. Membership shall be at the discretion of The County Register. Once accepted, you are required to pay the Fee as detailed on the Membership Agreement that incorporates these terms and conditions. You are entering into a binding contract based on these terms and conditions on the date that we receive your fee, notwithstanding whether or not you have signed an agreement.

Payments and payment terms

The fee payable is as set out on the Membership Agreement supplied and is inclusive of any applicable VAT at the current rate. We take payment on receipt of your order and accept no liability if our services are delayed if for any reason your payment has not been received. If it is not possible to obtain payment due from you, then we may refuse to process your order and/or suspend the service.

Matchmaking Service

Your personal matchmaking service will get underway when you have confirmed approval of your profile and we have all the necessary documents from you. We will send you recommendations of others on a one at a time basis whilst you are still seeking a partner. As a courtesy to all members, we will not offer you further recommendations when you have already accepted a recommendation from us and both parties involved have agreed to be put in touch with each other. It remains your responsibility to inform us whenever you are again free to receive another recommendation from us.

No guarantee can be given that any recommendation we put forward will satisfy all of your preferences in a partner. We reserve the right to suggest others to you who we consider may be acceptable to you, notwithstanding that prospective partners may match your preferences only to a degree, as this approach has proved successful for other clients. Members are required not to reject more than ten of the prospective partners that we may put forward for consideration. We cannot guarantee those we recommend will necessarily agree to proceed further and/or to meet you, as the choices made by others remain outside of our control. The number of others that we recommend or introduce to you may depend upon your own characteristics as well as upon how narrow or otherwise are your partner preferences and you accept that having or introducing more restrictive partner preferences will limit the number of recommendations we can offer to you.

Where introductions are guaranteed in your Membership Agreement, an introduction is defined as when you and your selected introduction both agree to be put in touch with each other. For the avoidance of doubt, the term ‘introduction’ does not imply any guarantee of a meeting between you and your selected introduction.

The County Register agrees to supply the member with a true assessment of people as far as it is able and will supply particulars accepted in good faith. We do not accept liability for the validity of the information provided to us and advise you to verify those particulars. Those sourced for you via headhunting and networking may not necessarily have paid a fee. However, we confirm that all persons we put forward have been interviewed and ID validated. You agree that we can share your approved profile with other dating agencies who we liaise with who also ID verify and interview members, solely for the purposes of our headhunting potential partners for you.

We guarantee to provide you with at least the number of introductions or recommendations as specified on your Membership Agreement, if these are required in your search to find a new partner. We will fulfil this guarantee, even if where necessary, we need to extend your period of service. This guarantee is subject to no significant change in your own circumstances or partner preferences likely to make matchmaking significantly more difficult or impossible and to your maintaining contact and being available for the service.

Safety and Confidentiality

You agree not to invite to your home for the initial meeting, any person introduced to you by The County Register. Any meeting is entirely at your own risk and you are recommended to take such precautions as are reasonably necessary for your safety. We shall not be held responsible for any conversations/communications taking place between the two parties introduced in any shape or form.

You must not discuss/show details or particulars of other members with other members or non-members at any time. You must not release any written information or photograph(s) provided by The County Register to any other person and doing so could result in termination of membership. The County Register requires that you keep all profiles of others secure until the conclusion of your membership at which time you should shred or fully delete profiles held electronically or return them to The County Register.

We are under a legal duty to supply services that are in conformity with this contract and in accordance with the Consumer Rights Act 2015 (the Act).

Suspending or Terminating Membership

The option to suspend the service and freeze your membership is only available when specified in your Membership Agreement. Where specified, you may suspend your membership by notifying us in writing in advance and any single period of suspension will be for a minimum of one month and a maximum equating to the maximum period of suspension allowed in your Agreement. If the permitted membership suspension time is exceeded, your membership will continue as if active membership and it remains your responsibility to let us know when you wish the service to be reactivated. Your membership will expire once your membership time has elapsed and we will not be required to meet guarantees for the minimum number of recommendations or introductions where the service has remained suspended beyond the maximum time permitted in your Membership Agreement.

Subject to the early termination provisions below, your membership will automatically be fulfilled after the minimum guarantee of recommendations or introductions has been reached, as stipulated in your Membership Agreement. However, if possible, we will provide further recommendations of others to you within the membership period, but this is not part of any guarantee.

The County Register shall be entitled to terminate your Membership in circumstances where:

  • The member has in the opinion of The County Register, exercised inappropriate behaviour. This may include but it not limited to: anything that deliberately or recklessly prejudices or damages the reputation of The County Register or Dating Options Limited or any of its subsidiary companies; or restricts or inhibits the use or enjoyment of our service by other members; or any act which is threatening or harassing towards any other member or employee;
  • The member repeatedly fails to maintain contact with The County Register during the member’s active membership;
  • The member is found to have provided false information to The County Register;
  • The County Register receives a serious complaint about the member, which, after investigation, it considers to be justified (such decision to be entirely at The County Register’s discretion and The County Register reserves the right to approach both parties concerned during an investigative procedure);
  • The member commits some other breach of these terms, wherein the sole opinion of The County Register such a breach reasonably justifies termination.

Refund Policy

For the avoidance of any doubt, in the event of a termination of this contract no refund will be applicable unless we have breached these terms and conditions or breached your consumer rights. You will not be entitled to any refund for any other reasons other than your legal right to cancel within 14 days of when this contract commences, and this includes but is not limited to, the formation of a lasting relationship before the expiry of your membership with us. This contract is for the maximum service term given in your Membership Agreement if required in your search for a partner, with no refund applicable for early termination.

Right to Cancel

Your contract with us commences on the date that we receive your first payment. The Consumer Contracts Regulations (Information, Cancellation and Additional Charges) 2013 apply and you have the legal right to cancel this contract for any reason within 14 days of the date that your contract commences, (the Cancellation Period). You have the right to cancel this contract within 14 days without giving any reason. The Cancellation Period will expire after 14 days from the date that your contract commenced. To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear written statement, e.g. using post or email: write to The County Register Ltd, Alcester Office, 8 Arrow Court, Alcester, Warwickshire, B49 6PU or email: [email protected] To meet the cancellation deadline, it is sufficient for you to send a clear written communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of Cancellation

Within the Cancellation Period if you cancel this contract, we will reimburse you all payments received from you. We will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this contract. You will not incur any fees as a result of the reimbursement. If you require us to begin services within the Cancellation Period, we require you to make an express request to do so. In such cases, your right to cancel continues until either the end of the Cancellation Period or the completion of the services, whichever is earlier. If you cancel during the cancellation period, we will charge you for any services provided up until the point when we receive your cancellation notice and will provide a partial and proportional refund accordingly. Specifically, the following deduction from your refund will be applied where applicable: a home/office-based full profiling consultation, £250 plus any travel costs we have incurred.

General

We may assign this contract for operational reasons or in connection with a business transfer or re-organisation. Otherwise, this contract is non-transferable. This contract is subject to English law and the English courts will have jurisdiction in respect of any dispute arising from this contract. If any provision shall be found by an English court to be unenforceable or invalid this shall not affect other provisions within this contract and all other provisions not affected will remain in full force and effect. Nothing in this agreement is intended to, nor shall it confer rights on any third party. Severability: if any provision in these terms and conditions is deemed to be illegal, unenforceable or invalid for any reason, it shall be deemed to have been struck out and the remaining provisions shall survive and continue to be binding and enforceable.

Your use of our services is solely at your own risk and we do not accept any liability for any harm, loss, damage, claim or expense, whether direct or indirect and howsoever caused, arising out of your membership and/or your use of our services or reliance upon advice or information provided by us. All warranties in respect of the service and /or such information, whether express or implied, are excluded.
